Irrespective of the recent delivered judgment of the Federal Court, with which it is easy to disagree, the whole matter of native customary rights in Sarawak and Sabah needs profound investigation. BN State administrations in both States steadily and comprehensively whittled away at these rights, relying on Courts subservient to the criminal BN government to approve these unjustified moves.
What is now needed is not a look at the rationale of the Federal Court’s judgment but a Royal Commission of Enquiry into the whole question of these rights in the Borneo States, how they have been whittled down or abolished, who was responsible for that and what should be done to restore these rights in toto and protect them in future.
Will PH do that much for those who have been so cruelly stripped of their heritage and rights?
